I acknowledge that I wish to participate in special events and projects for or related to Kids’ Meals Inc. (“Kids’ Meals”).
I am aware that these activities have certain risks that include, but are not limited to, injury, illness, death, threat of physical harm, or damage to personal property. I understand that there may be a great variety of other risks not known or reasonably foreseeable. I am voluntarily participating in these activities and agree to assume any and all such risks, whether known or unknown.
I further understand and agree that Kids’ Meals does not provide insurance to cover expenses for any harm that may arise from my participation in special event activities related to Kids’ Meals. Kids’ Meals strongly recommends that I carry my own health and medical insurance for purposes of potential harm related to my attendance activities.
By my signature below, and as consideration for being permitted by Kids’ Meals to participate in the special event activities and use the premises and facilities, I (on behalf of myself, personal representatives, assigns, heirs, guardians, spouse, next of kin, and children, collectively, “releasors”) do hereby release and agree to indemnify and hold harmless Kids’ Meals, the premises owner, and their respective employees, directors, officers, volunteers, agents, contractors, and representatives (collectively, “releasees”) from any and all liability, actions, claims, demands, of any kind and nature, arising out of or related to any damage, injury, loss, illness, harm, or death related to my participation in special event activities related to Kids’ Meals, including the acts, omissions, and negligence of the releasees. I acknowledge that this release includes claims related to the condition of the premises where the activities occur, as well as claims related to illness arising from COVID-19.
Photo/Likeness – I and Releasors additionally consent to and give Kids’ Meals the irrevocable license and right to reproduce each Releasor’s name, voice recording, photographic or video images, or other likenesses (whether composite or modified) for use in Kids’ Meals’ advertising, fundraising, or other business or commercial purposes, and understand that there will be no compensation for this use. Releasors and I also agree that Kids’ Meals will be the owner of any advertising, fundraising, or other business or commercial materials that make use of any of Releasors’ names, voice recordings, photographic or video images, or other likenesses. I and Releasors, moreover, fully waive and release any and all claims and/or liability related to the use of any such name, voice recordings, photographic or video images, or other likenesses. This Release applies during my participation as a Kids’ Meals event attendee and thereafter.
I acknowledge that this Waiver and Release of Liability Agreement is being signed by me voluntarily, without coercion, duress, or undue influence, and with full knowledge of its terms and effects.
